Experienced Attorneys in Texas Estate Law for Wrongful Death Cases

A wrongful death claim can arise when an accident causes a person’s death. The death may have been immediate, or due to injuries caused by the accident. When someone’s negligence—and a resulting accident—causes the wrongful death of another party, the deceased person’s estate can recover damages. Parents, children, and spouse may also be entitled to recover additional damages for the loss of their loved one.

If you are the parent, child, or spouse of someone who was killed due to the negligence of another party, you may be entitled to pursue a wrongful death claim. This may be true even if your loved, while he or she was still living, successfully pursued a negligence suit against the responsible party.

Remember that in order to recover damages on behalf of your loved one, his or her estate must have entered probate and have an estate representative appointed by a probate court. Because we are a full-service law firm, Jim Ross & Associates can handle the probate case as well.
